Seorang lagi bekas menteri minta tuduhan digugurkan dalam kes PKFZBekas Menteri Pengangkutan Tan Sri Chan Kong Choy (gambar) memfailkan representasi kepada Pejabat Peguam Negara bagi kali kedua untuk menggugurkan tiga pertuduhan menipu terhadapnya berhubung projek Zon Bebas Pelabuhan Klang (PKFZ).
Pihak defendan memaklumkan perkara itu kepada Mahkamah Tinggi Kuala Lumpur hari ini.
Mahkamah memutuskan 13 Januari sebagai tarikh sebutan semula kes.
Perbicaraan hari ini menjadi buruan media setelah usaha menghubungi peguam dan pendakwa raya menemui kegagalan.
Selepas beberapa panggilan telefon dan kiriman pesanan ringkas sejak pagi tadi kepada Timbalan Pendakwa Raya, Pejabat Peguam Negara Datuk Nordin Hassan dan peguam defendan, salah seorang peguam defendan mengesahkan perbicaraan itu dalam satu pesanan ringkas namun enggan mengulas panjang.
Permohonan sebelumnya kepada Pejabat Peguam Negara untuk tuduhan berkenaan digugurkan telah ditolak.
Chan dituduh pada Februari 2011 dengan tiga dakwaan menipu mantan Perdana Menteri Tun Abdullah Ahmad Badawi mencecah RM1.9 bilion berhubung projek penghantaran di antara 2004 dan 2006.
Beliau berdepan lima tahun penjara bagi setiap pertuduhan.
Projek PKFZ yang diilhamkan oleh bekas Presiden MCA Tun Dr Ling Liong Sik pada mulanya dianggarkan bernilai RM1.1 bilion pada 1997 namun meningkat empat kali ganda iaitu RM4.6 bilion pada 2007.
Pada 25 Oktober lalu, Dr Ling dibebaskan daripada pertuduhan menipu Kabinet setelah gagal mendedahkan terdapat pertambahan kadar faedah 7.5% dalam pembelian RM25 sekaki persegi dalam urusan pembelian tanah PKFZ walaupun mengetahui kadar faedah itu telah disertakan dalam harga asal.
Pejabat Peguam Negara tidak membuat rayuan kes itu yang berakhir pada Jumaat lalu.
Dalam penghakiman Dr Ling, Hakim Mahkamah Tinggi Datuk Ahmadi Asnawi mendapati bekas menteri itu tidak boleh dipersalahkan dalam maklumat tidak tepat oleh kementeriannya untuk pembelian tanah itu meskipun dokumen itu ditandatangani oleh beliau.
“Kesalahan itu patut diletakkan juga kepada pegawai Kementerian Pengangkutan yang mendraf dan menyediakan dokumen,” katanya. – 11 November, 2013.The Malaysian Insider

It’s not our area, up to MACC to investigate Attorney General’s alleged misconduct, says IGP

Inspector-General of Police Tan Sri Khalid Abu Bakar (pic) said it is not for the police to act on the allegations of misconduct by Attorney General Tan Sri Abdul Gani Patail.
Itโ€™s not our area, up to MACC to investigate Attorney Generalโ€™s alleged misconduct, says IGPHe said the allegations had to do with the misuse of power so it would be up to the Malaysian Anti-Corruption Commission (MACC) to initiate a probe.
"This is not for the police to handle. You should ask the MACC," he said today before delivering a lecture on Futuristic Policing at Universiti Sains Malaysia in Penang.
Khalid said the claims against Gani had to do with several cases that had been settled long ago, including the murder of Mongolian model Altantuya Shaariibuu.
"They have been repeated over and over again. What more do they want?
"There must be a limit to everything. You cannot politicise everything and confuse the people," he said.
It was reported last week that former Kuala Lumpur Criminal Investigation Department (CID) director Datuk Mat Zain Ibrahim and prominent lawyer Tan Sri Muhammad Shafee Abdullah met former prime minister Tun Dr Mahathir Mohamad in August to discuss Gani's alleged wrongdoings.
Also at the meeting, which was at Dr Mahathir's residence, were his former political secretary Matthias Chang and former Commercial Crimes Investigation Department director Datuk Ramli Yusoff.
Ramli was said to have briefed Dr Mahathir about his run-ins with Gani. The meeting also touched on alleged wrongdoings by Gani, such as the fabrication of evidence in the famous "black eye" case involving former deputy prime minister Datuk Seri Anwar Ibrahim in 1998.
On claims that Gani hired two American agents in his office and if the police was looking into it, Khalid said "he did not know about it".
Khalid said that was for Gani to answer.
On a separate matter, Khalid denied that police had done nothing about reports alleging that plantation and logging firms in Melikin and Serian in Sarawak had hired gangsters to threaten native landowners.
He confirmed that there were fights and said two people had been detained in relation to the incidents.
"We have investigated the matter and there is no gangsterism involved. But we will still watch them closely.
Sarawak Land Development Minister Tan Sri Dr James Masing had earlier told The Malaysian Insider that the threats against the native customary rights (NCR) landowners in Melikin, Serian, had prompted him to submit a "detailed account" to Bukit Aman and the Malaysian Anti-Corruption Commission (MACC) to enable them to investigate further.
Masing had claimed that there was non-action on the part of the police and it was worrying him.
The NCR landowners have claimed that two companies operating there have encroached on their land and the thugs silenced their protests.
Online news portal Sarawak Report had reported recently of “political interference” leading to the police inaction.
The portal claimed it could “reveal” how four gangster leaders, who were arrested “after the discovery of an enormous illegal arms cache at the disputed logging and plantation concessions at Melikin”, were freed “on instructions from ministers”.
Sarawak Report claimed the two companies - United Teamtrade Sdn Bhd and Memaju Jaya Sdn Bhd - had been granted controversial licences on NCR lands in the area.
The portal also claimed that the companies have strong ties to “powerful Barisan Nasional political figures in Sarawak”. - November 11, 2013.The Malaysian Insider

Another former transport minister in PKFZ case applies to drop cheating charges

Seorang lagi bekas menteri minta tuduhan digugurkan dalam kes PKFZFormer transport minister Tan Sri Chan Kong Choy has filed a representation to the Attorney General's Chambers for a second time, to drop the three cheating charges against him over the Port Klang Free Zone (PKFZ) project.
The High Court was informed of this today when the case came up for mention. The court then set January 13 for the next mention.
Today's proceeding was shrouded in secrecy as the prosecutors and lawyers refused to comment on its outcome. There was no word on which courtroom the mention would be heard.
One of the defence lawyers later confirmed that the proceeding did take place, but refused further comment.
Chan's previous representation to the AG's chambers for the charges to be dropped was rejected.
On October 25, former MCA president Tun Dr Ling Liong Sik was acquitted of a charge of deceiving the Cabinet by failing to disclose an additional interest rate of 7.5% to the purchase price of RM25 psf in the PKFZ deal, despite knowing that the interest rate was already included in the price.
Last Friday, the AG's Chambers decided not to appeal against the acquittal.
In acquitting Dr Ling, High Court judge Datuk Ahmadi Asnawi ruled that the former minister could not be held accountable for any mistake, misleading information or inaccuracy in the preparation of the ministry's documents regarding the land acquisition, although Ling signed the documents.
"If any, the blame should be apportioned wholly and squarely upon the officers of the Transport Ministry who drafted and prepared the documents," the judge had said.
Chan was charged in February 2011 with three counts of cheating then prime minister Tun Abdullah Ahmad Badawi of RM1.9 billion over the trans-shipment project between 2004 and 2006. He faces up to five years’ jail on each count.
The project was initially tagged at RM1.1 billion after it was mooted by Dr Ling in 1997, but more than quadrupled to RM4.6 billion by 2007. - November 11, 2013.The Malaysian Insider

Court nullifies conversion of three minors by father

IPOH: In a landmark decision, the High Court yesterday nullified the conversion of three minors by their Muslim convert father more than four years ago.

Judicial commissioner Lee Swee Seng, who delivered the judgment, said the conversions of Tevi Darsiny, 16, Karan Dinish, 15, and Prasana Diksa, 5, were unlawful.
Their names after conversions were Umu Salamah, Abu Bakar and Umu Habibah.
Their father, Mohd Ridzuan Abdullah, whose Hindu name before conversion was K. Patmanathan, converted them in April 2009 and then obtained certificates of conversion from the Perak Islamic Religious Department to show his Hindu wife, M. Indira Gandhi, as proof of conversion.
Indira then filed an application the same year to seek the nullification of the conversion on the basis that the conversions contravened the Administration of the Religion of Islam (Perak) Enactment 2004 and other laws, including the Federal Constitution.
She named as respondents the Perak Registrar of Converts (Pendaftar Mualaf), Perak Islamic Religious Department, Perak government, the Education Ministry, the Federal Government and Ridzuan.
Indira was represented by K. Shanmuga, M. Kulasegaran and N. Selvam. The first three respondents were represented by assistant state legal adviser Norazura Mokhtar, who also mentioned for the fourth and fifth respondents. Counsel Hatim Musa represented Ridzuan.
In his judgement, Lee said the conversions were null and void because the minors were not present before religious officials to utter the declaration of faith (kalimah syahadah) as required by the enactment.
"Although they are children, like those who have attained the age 18, they have to utter the declaration of faith in person (at the Perak Islamic Religious Department) before certificates of conversions could be issued to them.
"It is this court's interpretation that the children had to have expressed their desire to convert to Islam before the conversions could take place," he said referring to Sections 96 and 106 of the Enactment.
Lee said that the High Court of Malaya had superior powers to decide on matters related to conversion.
He also said if the word "parent" were to be taken to mean either father or mother then this would lead to "one parent converting the child today, and another parent converting the child tomorrow and the cycle will continue".
Lee said he believed the framers of the Federal Constitution did not have this in mind when drafting the supreme law of the land.
The court also found that Article 11, which gave every Malaysian religious freedom, included the right to educate and raise children in the religion of their parents.
"This is part of the right to practise other religions in peace and harmony as per Article 3 and part of the right of life and liberty as per Article 5 of the Federal Constitution."
Lee did not make a ruling on cost as he believed the respondents might appeal the decision.
Speaking to reporters after the decision was delivered, Indira, who was accompanied by her mother and another relative, said it was a good decision.
"I have been waiting for nearly five years.
"This is a very very touching moment for me and my kids.
"I am just waiting to deliver the (High Court) decision to them (Tevi Darsiny and Karan Dinish)."
The youngest child, Prasana Diksa, had been taken away by Ridzuan although the High Court had given full custody of all three children to Indira.
He had refused to hand over the child and her whereabouts are not known.

An Indian court has delayed a ruling against a teenager allegedly involved in last year’s gang-rape of a student, which led to her death.


Officials say the verdict which was expected to be handed down on Thursday has been adjourned until August 5.

The delay is due to a challenge pending in the Supreme Court seeking to change the legal definition of a juvenile. The teenager has pleaded not guilty.

If convicted, he can be sent to a correctional facility for a maximum three-year term.

He and five other men are accused of beating and raping a 23-year-old medical student on a moving bus back in December last year. The victim later died of internal injuries. The horrific nature of the crime shocked Indians and sparked mass protests across the country.

The victim’s family recently called on the court to try the teenager as an adult, alongside five other men initially arrested and put on trial following the assault.

“He committed the worst crime and even if he is a minor, the accused should not be allowed to walk free after three years,” the victim’s father said.

The five males and the juvenile were charged with murder, rape, kidnap, robbery and conspiracy. However, one of the adults died while in prison from a suspected suicide in March.

The four adults, on trial in a separate court, face a maximum death penalty if convicted.

According to the National Crime Records Bureau, one woman is raped every 20 minutes in the world’s second-most-populous country.

Empat lelaki yang dituduh menculik dan mencederakan seorang anak muda Cina sebelum menconteng “Saya hina agama Islam” didadanya didakwa menculik di mahkamah Shah Alam hari ini. 

Mereka adalah Asri Mohamad Jamil, 22, Mohd Mazli Sazeli, 26, Zulkarnain Abdul Rahman, 29 dan Agus Hariyanto Mahmod Hosen, 27, didakwa melakukan kesalahan itu di Restoran Muneer di Seksyen 25 pada 15 Julai pada 4.30 pagi.


Tiada pengakuan direkodkan.



Semasa prosiding, peguam suspek memberitahu Nurul Shahida Zainal anak guamnya mengadu dicederakan semasa dalam tahanan.


Majistret kemudian mengarahkan dua daripada suspek melakukan pemeriksaan kesihatan.


Ketika dibawa masuk ke mahkamah, dua daripada mereka menjeritkan “Allahuakhbar” selama beberapa kali sementara seorang lagi tertuduh kelihatan menangis.


Keluarga mereka juga kelihatan sangat emosi.

“Saya hina agama Islam” merupakan taktik oleh penculik agar beliau dipukul oleh orang awam jika mahu melarikan diri.

Egypt: Prosecutors want Morsi summoned for questioning in prison break case

CAIRO: Egyptian prosecutors on Thursday requested the summoning of ousted President Mohamed Morsi and 34 other Muslim Brotherhood leaders for interrogation in a 2011prison break case. 

According to judicial sources, the Supreme State Security Prosecution examined complaints accusing Morsi and other Muslim Brotherhood leaders of escaping from the Wadi al-Natroun prison during the January 25 revolution, and of spying for foreign elements. 

Prosecutors prepared a 41-page document with evidence against the defendants, which they handed over to prosecutor general Hisham Barakat in a meeting that lasted five hours, the sources said. 

Authorities last week had also launched a criminal probe against deposed Islamist President Morsi for alleged spying, inciting violence and ruining the economy. 

Egyptian prosecutors had announced the criminal investigation against Morsi and several other leading Muslim Brotherhood figures, including the Islamist movement's top leader Mohamed Badie. 

61-year-old Morsi, Egypt's first democratically elected president, was toppled by the powerful military earlier this month and since has been kept under detention along with some senior aides of his Muslim Brotherhood party. 

Morsi was last seen in public on June 26 and has been held at an undisclosed location. 

A foreign ministry spokesman, earlier this week had said, Morsi is in a "safe place" following his ouster. 

The military maintains it deposed Morsi in a justified response to popular demand after millions of people demonstrated against him. The Brotherhood claims it was a coup that reversed democracy. 

Complaints such as those against Morsi are a first step in the criminal process, allowing prosecutors to begin an investigation that can lead to charges.

In Putrajaya, some believe earlier action against extremists would have deterred sex bloggers posts

Alvin Tan and Vivian Lee are finding out the hard way what harm words and pictures can do to their community and themselves.
Their Facebook post and online nude pictures of themselves are now haunting them in the remand cell, just as much as inaction against others who bring disharmony haunts some ministers and deputy ministers in Putrajaya.
They believe that firm action against the likes of Datuk Ibrahim Ali for his threat to burn Malay bibles and Datuk Zulkifli Noordin for disparaging the Hindu religion would have been a deterrent for similar action by others.
"Firm action should have been taken before. Instead, we now have people pushing the envelope to see where the limits are," a Barisan Nasional (BN) source told The Malaysian Insider in Kuala Lumpur.
He said some ministers and deputy ministers have been discussing the sex bloggers collectively known as Alvivi and their brazen act of posting their Ramadan "bak kut teh" greeting on Facebook last week.
"This might not have happened if others who provoked and incited along similar lines had been charged in court for sedition," he said, pointedly referring to Ibrahim and Zulkifli.
The authorities have not taken action against both despite public outrage and outcry. Zulkifli even stood in Shah Alam on a BN ticket in the May 5 general elections but lost.
Ibrahim, who heads the right-wing Perkasa group, used to be an Umno member but quit before Election 2008. He won in Pasir Mas on a PAS ticket but lost in Election 2013 although the BN candidate withdrew from the race.
But outrage over a cow-head protest against a Hindu temple in Shah Alam on August 28, 2009 led to 12 protestors being fined RM1,000 each for illegal assembly by the local sessions court in 2010.
Two of the protestors were fined RM3,000 for sedition while one of the two was also ordered to serve a week in jail.
However, none of them were remanded before their case, unlike Alvin and Vivian in Kuala Lumpur yesterday. - July 19, 2013

Sex bloggers file revision to get bail

Sex bloggers Alvin Tan and Vivian Lee, who are in prison after failing to obtain bail, have filed for a revision in the High Court.
Their lawyer Chong Joo Tian said the appllication was filed today and hoped the matter could be heard next week.
"We have filed a revision on the refusal of the Sessions Court to offer bail to my clients and to challenge the decision to have a joint trial," he said.
A revision is a speedier way for the High Court to hear contentious issues instead of an appeal.

They have been charged under Section 5 of the Film Censorship Act 2002 for publishing indecent photographs online between July 6 and 7.
If found guilty, they can be fined not less than RM10,000 or not more than RM50,000 and/or face a jail term not exceeding five years.
The other charges thrown at them are Section 298A of the Penal Code for promoting enmity between different groups of religion or race and doing acts prejudicial to maintaining harmony, by publishing an offensive Ramadan greeting, which carries a minimum jail term of two years or a maximum of five years; and Section 4(1)(c) of the Sedition Act 1948 for posting seditious material through said offensive greeting which carries a maximum fine of RM5,000.
Sessions Judge Murtazadi Amran had allowed the prosecution to hold trial at one go although the offences were allegedly committeed under three different laws.
Chong said his clients would be prejudiced if a simulataneous hearing was held.
"We agree to a joint-trial under the Sedition Act and the Penal Code. The charge under the Film Censorship Act must be separate," he said. - July 19, 2013.

KUANTAN: Mahkamah Tinggi di sini, hari ini memerintahkan kes saman membabitkan bekas EXCO Kelantan, Datuk Husam Musa terhadap blogger, Syed Azidi Syed 
Abdul Aziz atau lebih dikenali sebagai 'Kickdefella' dibatalkan dengan kos RM40,000. 

Keputusan itu dibuat Hakim Datuk Seri Mariana Yahya dalam kamar dihadiri peguam defendan, Datuk Jahaberdeen Mohamed Yunoos dan peguam mewakili Husam, Ahmad Mustaqim Zaki dari Tetuan Hisham Fauzi.

Berikutan keputusan itu, Jye Yee dan May Ling masing-masing dibawa ke Penjara Sungai Buloh dan Penjara Kajang untuk ditahan sehingga kes dibicarakan. Mahkamah menetapkan 23 Ogos depan bagi sebutan kes.

Mun Tatt menunjukkan gambar selepas dipukul serta dibogelkan oleh empat penyamun ketika ditemui pada sidang media di rumahnya, di Klang, semalam.
Klang: Seorang pemuda yang diculik sekumpulan lima lelaki Isnin lalu selepas dituduh pernah menulis komen menghina Islam di Facebook dan Twitter, semalam menafikan kejadian itu berunsur perkauman. 

Ng Mun Tatt, 21, yang cedera di muka dan badannya berkata, ketika ditahan, kumpulan itu tidak mengaitkannya dengan perbuatan menghina Melayu atau Islam, berbeza dengan khidmat pesanan ringkas (SMS) yang disebarkan. 
Beliau yang mengadakan sidang media bersama abang iparnya, Mak Wai Weng berkata, keluarganya menganggap kejadian itu dilakukan pihak yang mahu mendapatkan wang tebusan. 


“Saya tidak pernah mengeluarkan sebarang kata-kata menghina masyarakat Melayu dan agama Islam dalam laman sosial Facebook dan Twitter selain mengakui tidak fasih berbahasa Melayu,” katanya. 

Katanya, pada hari kejadian, dia bersama teman wanitanya dan beberapa rakan pergi ke sebuah restoran di Taman Sri Muda. 

“Tidak sampai 10 minit, saya didekati dua lelaki yang meminta mengikuti mereka dan tiga lagi lelaki ke sebuah flat sebelum meminta saya menghubungi keluarga untuk mendapatkan wang. 

“Mereka menutup mata saya dengan kain serta menumbuk dan memukul saya menggunakan kayu seluruh badan. Saya juga dibawa ke tiga bank untuk memaksa saya mengeluarkan wang,” katanya. 
Dipaksa hidu gam 

Mun Tatt berkata, selepas itu, dia dibawa ke satu kawasan kebun kelapa sawit, dan ketika di sana, dia terus dipukul dan dipaksa menghidu gam. 

Katanya, dia ditelanjangkan kumpulan itu sebelum perkataan ‘saya hina agama Islam’ ditulis pada badannya dengan alasan jika dia melarikan diri, tentu akan dipukul orang Melayu yang ternampak apa tertulis pada badannya. 

Mun Tatt berkata, dia hanya mengetahui dakwaan diculik kerana menghina orang Melayu dan Islam selepas dimaklumkan kakaknya yang menyatakan seseorang memuatkan dakwaan itu dalam Facebook selain membaca laporan akhbar berbahasa Cina, sehari selepas kejadian. 

Sementara itu, Wai Weng berkata, dia dihubungi seorang lelaki yang tidak dikenali jam 5.15 pagi Isnin lalu memintanya memasukkan RM5,000 ke dalam akaun milik Mun Tatt jika mahu adik iparnya itu dilepaskan. 

Katanya, beliau yang pada mulanya meminta jumlah itu dikurangkan kepada RM500 kerana tidak dapat mencari wang RM5,000 kemudian melakukan pemindahan RM3,000 ke akaun adiknya selepas dipersetujui lelaki berkenaan.

Alvin, Vivian didakwa hari ini dengan 3 pertuduhan yang boleh dihukum 5 tahun

Alvin, Vivian didakwa hari iniKuala Lumpur: Alvin Tan Jye Yee dan Vivian Lee yang menghina agama Islam dengan memuat naik gambar makanan haram sebagai juadah berbuka puasa dalam Facebook baru-baru ini, akan didakwa di Mahkamah Jalan Duta, hari ini. 

Mereka boleh didakwa mengikut Seksyen 4(1) Akta Hasutan atau pertuduhan pilihan mengikut Seksyen 298A Kanun Keseksaan. 
Peguam Negara, Tan Sri Abdul Gani Patail, berkata mereka akan menghadapi tiga pertuduhan mengikut Akta Hasutan serta Akta Komunikasi dan Multimedia.“Alvin dan Vivian akan tampil di Mahkamah Jalan Duta esok (hari ini) selepas siasatan ke atas mereka selesai dilakukan Suruhanjaya Komunikasi dan Multimedia (SKMM) pada Isnin lalu,” katanya ketika dihubungi semalam. 



Penjara lima tahun

Di bawah akta itu, mereka yang disabit kesalahan boleh dihukum penjara tidak kurang dua hingga lima tahun serta denda tidak kurang RM5,000 atau kedua-duanya.

Ketua Jabatan Siasatan Jenayah Kuala Lumpur, Datuk Ku Chin Wah, pula berkata mereka dijangka tampil bersama peguam pada jam 8.30 pagi.
“Setakat ini Polis Kuala Lumpur gagal menghubungi mereka selepas diminta menyerah diri di Ibu Pejabat Polis Kontinjen (IPK) Kuala Lumpur bagi membantu siasatan. 

“Namun, mereka menghantar SMS kepada pegawai penyiasat di Seremban dan memberitahu akan datang ke Bukit Aman. 

“Difahamkan tindakan mereka ke Bukit Aman atas nasihat peguam yang akan mewakili mereka. Sekiranya gagal hadir, polis akan menge-luarkan waran tangkap,” katanya.

Chin Wah berkata, kertas siasatan dibuka oleh Suruhanjaya Komunikasi dan Multimedia (SKMM) dan polis selepas menerima tiga laporan polis daripada badan bukan kerajaan (NGO) sebelum ini.

Isnin lalu pasangan itu disoal siasat hampir 11 jam di pejabat SKMM, di Jalan Tun Razak, di sini, bagi memberikan keterangan mengikut Seksyen 233 (1) Akta Komunikasi dan Multimedia kerana menyalah guna kemudahan media sosial.

Pasangan itu yang juga bekas penuntut National University of Singapore (NUS) didakwa mempersendakan Ramadan dengan memuat naik gambar dalam laman sosial Facebook mereka menikmati hidangan dengan keterangan gambar ‘Selamat Berbuka Puasa dengan bak kut teh (sup tulang babi), wangi enak dan menyelerakan’ berserta logo halal.

Umat Islam marah

Tindakan mereka bukan saja menimbulkan kemarahan umat Islam, malah mendapat tentangan kaum Cina sehingga Pengerusi Social Care Foundation, Tan Sri Robert Phang, menyifatkan tindakan mereka melampau dan menyentuh sensitiviti umat Islam.

We knew of possible Sulu intrusion but details were sketchy, says senior Special Branch officer

Malaysian police had prior information of a possible landing by Sulu intruders in Lahad Datu last February but the details were sketchy and did not qualify as intelligence, said a senior Special Branch officer.

His comments, the first by a senior police officer, come in the wake of the disturbing disclosure at the on-going Royal Commission of Inquiry on illegal immigrants in Sabah where the Lahad Datu district officer, Zulkifli Nasir, had testified that police had informed him about the planned landing of the Sulu intruders.

Zulkifli told the panel he was informed of this by the Lahad Datu police chief, Supt Shamsudin Mat.

"I was warned not to leak any news about the issue," he told the five-man RCI panel.

This revelation at the RCI raised several questions, notably why Malaysia's security agencies were caught off guard by the arrival of the Sulu intruders, led by Agbimuddin Kiram, the brother of the sultan of Sulu, Sultan Jamalul Kiram.

The Special Branch officer told The Malaysian Insider that despite the information, police did not have any intelligence report on the gunmen, when they were coming, or if they were armed.

"We did not know why they were coming to Malaysia, whether it was to steal, to attack or to wage war," he revealed.

"It was impossible to monitor the Sulu people as they have been coming in and going out freely since the early 2000s.

"They have families and relatives living in Sabah and they often come over to visit them. It is difficult to monitor their comings and goings."

The source added that Malaysian police do not have intelligence coverage which extends to southern Philippines, especially among the Sulu people.

He said the Suluks had been entering Malaysia in small numbers through various points along the coast of Lahad Datu and gathering in Kampung Tanduo.

"By then, Malaysian security forces were alerted to their presence and were sent to the village to surround the intruders," the officer said.

"Even though they had intruded into Malaysia, we didn't want any bloodshed. We sent in negotiators to try and reach an amicable solution."

The officer said the deaths of the policemen and soldiers in Ops Daulat was due to unavoidable circumstances and deception by the enemy.

"In the first incident on March 1, policemen were lured into an ambush by the terrorists who pretended they wanted to surrender by waving a white flag.

"The terrorists didn't live up to their end of the bargain; they took advantage of our good nature and ambushed our boys."

The source said in the second incident at the squatter colony in Palau Gaya, Sempron, the policemen had walked into the intruders' headquarters.

Ops Daulat claimed 65 lives including six civilians and 10 Malaysian security personnel.

The officer said many of the armed Sulu intruders were between the ages of 50 and 60 but they were fitter than most men their age due to the hard life they had lived.

Inspector-General of Police Tan Sri Khalid Abu Baker declined to comment on the revelations made by Zulkily on Tuesday.

"The Lahad Datu police chief (Supt Shamsudin Mat) will be giving his testimony at RCI today," he said, adding he did not want to comment on the issue now for fear of being held in contempt. - July 18, 2013
